(86901) PUBLIC NOTICE CITY OF KINGMAN ORDINANCE NO. 1985 AN ORDINANCE BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF KINGMAN, ARIZONA APPROVING A COMPREHENSIVE UPDATE TO TITLES 1-6 OF THE CITY OF KINGMAN ZONING CODE DATED APRIL 6, 2021 INCLUDING AMENDMENTS THROUGH JUNE 3, 2025, FOR THE PURPOSES OF REORGANIZING THE ZONING CODE TO ALLOW FOR GREATER READABILITY AND NAVIGATION WHILE ALIGNING THE CITYS PROCEDURES AND APPLICATIONS (TITLE 2), ESTABLISHMENT OF A FUTURE PLANNING AND ENGINEERING DEVELOPMENT STANDARDS (PEDS), ADOPTION OF A NEW LAND USE MATRIX (TITLE 3), NEW AND UPDATED DEVELOPMENT AND DESIGN STANDARDS (TITLE 4), AND A COMPREHENSIVE REFORM TO THE CITYS DEFINITIONS PERTAINING AND REFERENCED IN THE JANUARY 1, 2026 ZONING CODE. WHEREAS, the city wishes to amend Titles 1-6 of the Zoning Ordinance to reorganize the code for improved clarity and usability, align approval authority with updated Arizona Revised Statutes, update the development review process, expand signage requirements, expand the land use matrix, expand supplemental standards for use-specific standards, and update parking requirements, and WHEREAS, the effective date of this Ordinance is 12:01 A.M., January 1, 2026. WHEREAS, at the November 12, 2025, Planning and Zoning Commission meeting, the commission voted six (6) to zero (0) to recommend approval of the proposed text amendment, and WHEREAS, pursuant to Section 2-50.030 of Zoning Ordinance of the City of Kingman on November 18, 2025, the Mayor and Common Council of the City of Kingman held a public hearing on the proposed text amendment; and WHEREAS, the Mayor and Common Council of the City of Kingman has taken into consideration the individual property rights and personal liberties of the residents of Kingman prior to adopting this ordinance. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Common Council of the City of Kingman, Arizona as follows: SECTION 1. Sections of the City of Kingman Zoning Ordinance is hereby amended as shown in Attachment A with the red strikethrough text showing deletions and bold red underlined text to show the additions and Attachment B showing the final version including the new land use matrix. SECTION 2. The document known as the City of Kingman Zoning Code dated April 6, 2021 and as amended effective January 1, 2026, which is made public record by Resolution 5581, is hereby referred to, adopted, and made a part hereof as if fully set out in this Ordinance, as shown in Attachment B. SECTION 3. Penalties for violations of these sections shall be in accordance with Section 1-8 of the Code of Ordinances of the City of Kingman, Arizona. SECTION 4. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
